Proving fraud may be difficult (that's why The Justice Dept. has to work their way up the food chain)...Yet, I'm quite sure Lay, Fastow, and Skilling will be nailed for insider trading. The person heading up the Justice Dept. team is a pitbull who has successfully nailed big mob bosses in the past --> this will be even higher profile BUT I hope she succeeds in a big way. I also hope jpgill's friends at Milberg Weiss BURY Lay, Fastow, and Skilling with some effective lawsuits so we'll atleast some penalties paid. At a minimum, the multi-year legal bills for a posse of 1st tier lawyers could cost the corrupt Enron execs a fortune...=)
