it doesn't seem likely to me that a judgement can be made on the basis of his SI postings...lot's of people were extremely bearish (self included) prior to 9/11...

if he did something extremely unusual like short airlines right before the incident, that might be considered supporting circumstantial evidence that he had some type of prior knowledge of the 9/11 attack, but most likely if they are going to include prior knowledge of 9/11 (which i'm not sure it totally relevant to insider trading charges) i'm not sure what "crime" was committed.

should make his stay in prison interesting though.
