Jeffrey Royer, a former FBI agent in Oklahoma and New Mexico, was released subject to electronic monitoring pending a Thursday bail hearing in federal court in Brooklyn, N.Y. Lynn Wingate, an agent in New Mexico on administrative leave, was released on $100,000 bond. Both are charged with supplying short-seller Anthony Elgindy with confidential information from FBI databases that he and others used to drive down the prices of stocks they were shorting and to extort shares from targeted companies. There were hints at the hearing that prosecutors may have more information up their sleeves. Assistant U.S. Attorney Kenneth Breen said during the hearing that "classified information" had been found among Royer's belongings at Wingate's New Mexico home that "could develop into something more serious." Breen wouldn't comment further, but he said last week that Elgindy may have had advance knowledge of the Sept. 11 terrorist attacks. Lawrence Gerzog, a lawyer representing Royer, said that "he is innocent and we intend to go to trial." Ian Wankwitt, a lawyer for Wingate, wasn't available for comment after the hearing.
