Your point is moot. This appears to be a case of blatant corruption by a munipal government:

Land grab -- A city in California's Orange County is poised to do what few if any municipalities in the United States have ever done: use the government's power of eminent domain to seize a church's property so that it can be given instead to a large commercial retail company. The Cottonwood Christian Center recently spent more than a year and $13 million to acquire a half-dozen individual parcels as part of a plan to construct a new facility to serve the church's rapidly growing congregation. During the paperwork approval process, the city of Cypress, Calif., secured an interest in the property from Costco, a warehouse shopping chain. In April 2001, the city began eminent domain proceedings to take the property from the church and transfer it to Costco. Cottonwood filed suit in federal court to halt the transfer charging violations of the U.S. and California state constitutions, along with several statutes. The Cypress City Council is scheduled to vote sometime this week on whether to finalize the seizure of the 18-acre parcel near the Los Alamitos Race Track.
