Either there is domestic intelligence gathering or there is not.
The FBI has always had domestic intelligence gathering. The difference now is that Ascroft seems to think that the loose cannon approach to gathering data is somehow better than having a plan. The agents assigned to investigate terrorists have always been able to conduct survelance, read the internet (more closely than you or I), or otherwise gather intelligence.

The difference is that the agents were gathering this intelligence according to their assignements. Ashcroft just wants to cover up the fact that he pulled most of the agents off of anti-terror work so they could consentrate on pornography, medical pot clinics, and physicians who may assist in suicides. Ashcroft just wants a giant CYA proposal.
