You are quite correct, Sir.

And, the Controlled Substances regulations were the method that the A.D. chose to assert in his attack on the Oregon regs.

The A.D.'s challenge has, so far, been rejected in Federal Court... the court ruling that this is clearly an area of State control, but it will no doubt make it all the way to the Supremes.

But, no, Gao was claiming that the Constitution gave the Feds the right to over-rule State murder regs... and I simply pointed out that powers not specifically granted to the Feds under our Constitution, are reserved for the States.
