Ex-Fashion Boss Sentenced in Scheme

.c The Associated Press

NEW YORK (AP) - A former fashion executive for the Perry Ellis label was sentenced Monday to three years and a month in jail for a stock fraud scheme engineered by a defunct Long Island boiler-room brokerage.

Elliot Lavigne, the former chairman of Perry Ellis Menswear, was ordered to serve the term and pay $8 million in restitution during sentencing by U.S. District Judge John Gleeson in Brooklyn.

Lavigne, of Saddle River, N.J., pleaded guilty Aug. 2 to conspiracy to engage in money laundering involving the proceeds of securities fraud.

Lavigne already has paid $1 million toward the restitution and was to pay $12,000 a month for five years after his release from jail toward the full amount.

Authorities said Lavigne struck a secret deal with an executive with Stratton Oakmont Inc. in Lake Success, N.Y., to make illegal trades and split the profits. They estimate Lavigne made $7.2 million between 1991 and 1996.

Prosecutors called the now-defunct firm ``the most infamous boiler-room brokerage firm in recent memory.''
