They are just following military law, not civilian law.

That's why whistleblowers in and out of the military will be the protection, if they are protected.

And why the administration practically assumes martial law, in effect if not in fact - that's the subtext of the various vague war declarations.
The clue is in the reaction two weeks ago to the "Bush Knew" headlines, and threats by Ari and Cheney, "better watch what you say", and "unpatriotic to criticize"

They are either confused on the difference between martial law and civil law, or they already feel they're no longer restricted by pesky civil law, such as requirements for evidence, due process, and domestic spying.

For this scenario to be enforced requires the highly public arrest of a few civilian protesters, for "valid" reasons. Arrest and prosecution of military protesters is a start in this public dialog of how to deal with criticism of the President.

These events may be publicized randomly, but looked at from a more cynical view, it's more likely they are timed to be released on the eve of the Congressional intelligence investigation, and the goal is to warn any whistleblowers that haven't come forward, and to defuse potential explosive reaction if any more whistleblowers announce major accusatory evidence.

The message we'll hear if a major scandal breaks out of control will be, "don't criticize the pres, he's doing what he can, it wasn't his fault personally, let him help clean things up", etc., along with the usual "this is wartime, you're a traitor to criticize the holy president, and if you were a soldier you'd be shot, so thank your lucky stars, get back in your house and wait for further instructions".
