The hits keep on coming... 07:03 ET Tyco ex-CEO probed regarding misuse of funds (TYC) 17.30: The Wall Street Journal reports that NY prosecutors are looking into whether TYC's former CEO improperly used co funds to purchase his $18 mln NY apt and whether he received interest-free loans from the co to buy costly artwork; also, the SEC has opened a preliminary investigation into whether Kozlowski didn't pay sales tax on the artwork and that the art was purchased with a co loan.

06:47 ET Intel downgraded by Merrill Lynch (INTC) 28.18: Merrill Lynch downgrades to near-term NEUTRAL from Strong Buy; believes company will have to be conservative in its mid-qtr update this afternoon, and that the prospects for sequential growth in the Jun qtr are quickly fading; believes 2003 capex will be flat but doesn't expect comments on that in today's call; stock down 1.07 at 27.11 pre-market.
