That may be correct, but it would be a "true" non-recurring expense, and should be excluded from analyst EPS estimates.

I am pretty sure that the cash settlement with Intergraph was included in the Q1 results. There is another amount contingent upon the outcome of the Texas trial and any appeal but that is a good way into the future.
