The article was written during the detention of foreign terrorists. Since the proposal was toward foreign aliens believed to be involved in terrorist acts, which constituted an invasion, then the constitution supports his position.

ARTICLE I, SECTION 9
The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
