OT -- Dave:

The fact that you misinterpreted a perfectly legitimate and accurate e-mail does not condone your act of publicly posting a Private Message. The information contained therein was nothing more than was said in a public forum attended by many analysts and investors . . . the simple fact that you hadn't heard about it yet and jumped to an erroneous conclusion doesn't justify your action.

If someone were to send you a message tomorrow morning that General Magic was being bought out for $2.00 per share, would you consider that to be "inside information" just because you were sleeping when the news was announced and didn't know about it until you read their message? Might you not perhaps simply check a quote on the stock or look at the Dow Jones News before accusing them of having inside information?

If you were so concerned that you were in receipt of inside information and wanted no part of it, you should have notified the SEC or at least gotten back to the sender for clarification. And the fact that you tried to implicate Goldman Sachs as being involved in your inside-information fantasy was both laughable and tragic.

I repeat: The public posting of a PM is inexcusable and reprehensible, regardless of your motivation. This is, of course, my belief. You, of course, are free to believe what you want and can choose to conduct your life any way that you'd like. But please don't expect me to trust you.
