There is a difference between failing to specify all contingencies, and being in material agreement about what the contract expressly entails, or between intending to resolve outstanding issues, and having done so. As far as I can see, the instance you adduce, where there is an unresolved issue about the oil change, is sufficient to indicate that there is not yet a contract. But even if that were debatable, it is not clear that a contract exists......
