"That isn't evidence of much enforcement of the TOU imo."

Anybody can get away with anything, if their ultimate goal is to prove that they can accomplish a bad deed. By the time they are apprehended and consequences are delivered the deed is long ago a done deal in most cases. Some times what starts out to be a fairly harmless lark can escalate to something quite serious when unchecked. So the responsible thing for caring individuals to do is intervene when a problem is observed, hopefully before it gets out of hand. The assumption most of us go on is that the consequences of eventually getting caught and punished far outweigh the benefits of succeeding in delivering the mischief. Unfortunately this is not always true. Its a dangerous game to play and one can get lost in his own masquerade in the process (sorry leon).

Of course I don't believe any of us gets away with anything given the fullness of time, but that's me.

Actually a to or about does not appear to me to be about the terms of use- it is more about personal idiotsyncracies and personal sensitivities. If either of the posters in a to or about really violated the TOU they would be kicked off. What you are really complaining about is that the selective enforcement of other posters is not being enforced- I.E. that people who wish to restrict the posting habits of others are not being supported. I can't say I think that is a bad thing. I think toorabouts are ridiculous. Look at how poor Jewel tried to use one on SMBR, emotionally in a little tiff, saying I harassed him because I thought he was silly.
