I'm opposed to the death penalty in general, mainly on the historical racial and economic skew of people fried versus people not fried for similar crimes. But, to tell the truth, I found the SC reasoning for reversing itself obscure. They seemed to be endorsing political sensitivity as a legal argument, which seems odd for a mostly conservative court. Or maybe they're getting all squishy on the issue, there was this other recent reversal: Man With Sleeping Lawyer Wins Retrial story.news.yahoo.com , more completely, Supreme Court Sides with Inmate Whose Lawyer Slept story.news.yahoo.com

As far as this case goes, the details are pretty unappetizing. There have been much more dubious cases, it's a lot easier to get retarded people to say what you want them to say in interrogation than normal people, and what they say under interrogation conditions can be quite unrelated to the truth, not because they want to deceive, but because they're easily manipulated and want to please.

No understanding of what he was doing? Then why go to an isolated field? Why not the police station and shoot him in front of the cops?

Three year olds in nursery school wait for the teacher's back to be turned to kick over somebody's block tower. Six year olds sneak cookies when their mother isn't looking. Ten year olds smoke not in the living room, but behind the barn.

It's about more than "understanding what he was doing" at a specific moment. What makes adults capable of not yielding to destructive impulses is much more complicated than "not understanding" the act itself.
