I wonder how it can be considered COnstitutional in relation to the BIll of RIghts which protects the will of the minority against the will of the majority.
Would you care to cite the text of the amendment that says that? You may may wish to believe the Bill of Rights says that, but it doesn't.
Capital punishment was common at the time the Constitution was written and adopted and still is. I know of no evidence that indicates ANY of the the founders opposed it.

Years ago in Ca we had a referendum to reinstate the death penalty. I was first going to vote in favor of reinstatement but as I walked into the voting booth, and saw the lever I suddenly realized that by pulling the lever on the "yes" vote, I was responsible for the death of someone...............I completely changed my mind and voted against reinstatement.
And some years later, when Rose Bird, Chief Justice of the CA Supreme Court, who never saw a DP verdict she would uphold, came up for re-confirmation by CA voters, she lost badly.

Sounds nice. But is it right? Are an eight year old child with an IQ of 100 and a 45-year-old man with an IQ of 50 REALLY the same? Somehow I doubt it.

They are clearly not making any rational decisions in relation to the ethical and moral code upon which our laws are based.
That 45-year-old doesn't know what's right and wrong? Hmmmmm........

Sorry. I don't believe it.
