Gemstar Loses Patent Ruling on TV Set-Top Boxes

WASHINGTON (Reuters) - A U.S. International Trade Commission judge ruled on Friday against Gemstar-TV Guide International Inc. which claimed three companies infringed on its patents for cable television set-top boxes.


Gemstar, the maker of interactive programming guides for television, complained in February 2001 that EchoStar Communications Corp. , Pioneer Corp. , SCI Systems Inc. and Scientific-Atlanta Inc. were importing set-top boxes that infringed on its patents.

"It is the administrative law judge's final initial determination that there has been no violation by any of the respondents ... in the importation into the United States, sale for importation, and the sale for within the United States after importation of certain set-top boxes and components thereof," the order said.

Gemstar has been seeking millions of dollars in penalties in a civil suit against Scientific-Atlanta in federal court.

Before the administrative law judge heard the case, an ITC attorney presented a report that said Gemstar had no basis to claim that its rivals were infringing on its patents
