I don't think he should be released either. Being an American citizen and having been captured on US soil under civilian law, he should be held and tried under civilian. Just charge him. The article mentions treason. He also appears to be guilty of conspiracy at a minimum. Charge him and hold him under no bail until trial.

The military does not have to charge an enemy combatant with a crime, and can arrest and detain someone indefinately based solely on their classification as an enemy combatant.
There goes habeas corpus.

Nancy Skinner, a very liberal talk radio host, was going on about this today. Her contention was that they picked him up too early. He should have been followed until he did something. She was asked if Padilla had given his tailers the slip and blow a dirty bomb in Chicago would she then blame the administration? No she answered, proving she just can't tell the truth.
