Now what's the punishment under your scheme?

There is not PUNISHMENT. How can I make that clearer?

As for how her case is disposed, first, she makes reparations to her husband's family, as decided by the panel. Then she gets sent off to that facility where they evaluate whether or not she's a danger to society. If they decide that she is, she goes with the tier 1 criminals, who are kept from society for as long as they are dangerous. Otherwise she stays in the facility being evaluated and rehabilitated until she's deemed safe to be out in society.

"But let's deal with the case I had in mind: the battered wife shoots her husband. Not at the time he's attacking her. He's asleep. She puts the pistol to his head and pulls the trigger. Murder 1."

It seems she has already suffered enough. She attacked her attacker who was making her life a living hell and poses no threat to anyone.
