I can see no advantage, unless I had greater faith in the probity of the persons involved in the negotiations. In principle, tailor made is better than off the rack, but not if the tailors are incompetent.

To designate someone responsible upon conviction is insufficient. After all, if I lose a civil suit, I am held liable. Holding someone accountable means making clear the difference between ordinary liability and actual malice. One cannot do that without being punitive. If you prefer a fine, that may sometimes do. However, incarceration has the advantage of ensuring that one is discommoded, since no one likes to be regimented and unable to pursue one's own activities. Fines may not hurt enough, especially if designed not to financially ruin one.........
