We were talking, I thought, about the difference between a regular system and one that was ad hoc.

We started out talking about the role of retribution. I offered that there were alternatives to a retribution/punishment based model and I sketched one out for you per your request.

As far as protection goes, incarceration is the only way to protect for any length of time.
My model uses incarceration for convicts who are dangerous to society. It doesn't use incarceration as a catch-all. And it incarcerates not as punishment but to separate dangerous criminals from society until such time as they are not dangerous or are acceptably dangerous rather than for a cookie-cutter period of time. My model specifies releasing incarcerated criminals when they learn enough to support themselves by acceptable means or when they are too old to be much danger. I laid that out.
