If the government allowed loopholes in the system, you can't find fault with a company for legally exploiting them.

You're taking the Goreian approach to business,ie, "No controlling legal authority". These companies PAID, via campaign $$$ for these pols to implement a system which the enegry companies KNEW they could exploit. That is how they designed it.
