It's a lottery only in the sense that among those charged with similar crimes, it appears to be largely random which ones are charged with a capital offense and which with life-in-prison or lesser offenses. But I suppose that "flaw" in the system could be alleviated by frying everyone who commits murder. It could also be that the seeming randomness in the system is actually the taking into account by prosecutors of factors which are hard to convert into tangible statistics.
