that wasn't the question. You were asking about constitutionality and the fact that we had the same constitution back then. I was pointing out that the congress back then didn't seem too concerned about the US constitution back then.

And from the comments I see in that article you just posted, they current congress seems to be similarly minded. Not surprising, they are going for votes, not principle.
