Regarding the price reflecting inside information about the SEC inquiry, although we've come to learn that almost anything is possible a simpler explanation is that the price is reflecting an extreme level of fear and negativity. This is not specific to Elan, but Elan has certainly had a huge helping of it.

During an excessively fear-driven market climate, it helps to be reluctant to jump to negative conclusions based merely on what the stock price is doing. It can be extremely misleading to assume the sky is falling simply because the stock price is, just as it can be hazardous to assume everything is rosy just because the stock price is up.
