SAN DIEGO, June 27 (Reuters) - Software maker Peregrine Systems Inc. (nasdaq: PRGN - news - people) (nasdaq: PRGN - news - people) on Thursday said Nasdaq informed the company it plans to delist its stock at the opening of business on July 5. Peregrine said it intends to appeal the decision.

Peregrine said it is out of compliance with Nasdaq rules since its accountants at Andersen informed the company that its financial statement from 2000, 2001 and 2002 should not be relied on.

Peregrine said the restatements put the company out of compliance with Nasdaq's rule requiring that all U.S. Securities and Exchange Commission reports be filed with Nasdaq on a timely basis.

"Peregrine intends to avail itself of the prescribed appeal process with Nasdaq to retain its listing during the audit process being undertaken by our new independent accountants, PriceWaterhouseCoopers," said Gary Greenfield, Peregrine's chief executive.

Shares of San Diego-based Peregrine closed at 83 cents in Nasdaq trading on Wednesday. Because of the company's filing delinquency, an "E" was added to its stock symbol. The company now trades as "PRGNE" on the Nasdaq stock market.

George S.Cole: Kenneth Fisher actually turned bullish in mid-May and went from cash to 100% invested (or something close to this) in ONE day in mid-May. Needless to say, he was premature and lost considerable amount of money for his private clients, subsequently sending out a "mea culpa' letter to his private investors. This (and the letter) were posted on the "Clown-Free Zone" thread a week ago.

Be careful of following his advice to "Buy Stocks Now". As he admits in his letter, he was fooled by this bear market into being premature.
