I have problems with the DP because of its irreversibility combined with a system that gets it wrong at times. I don't see, however, how the penalty itself "deprives innocent people of a significant opportunity to prove their innocence", unless the Court is saying that this "significant opportunity" arises only during the long years in jail. And the logic there leads to a conclusion that depriving people of liberty by jailing them also "deprives [some] innocent people of a significant opportunity to prove their innocence", since in jail they don't have much chance to track down exculpatory evidence.

Throwing out the entire criminal justice system because some cases are wrongly decided is a disturbing precedent.

On a related note, saw Spielberg's Minority Report over the weekend. A fascinating and brilliant look at criminal justice through a different lens.
