In reversal on privacy, Drkoop will sell members’ e-mail addresses to online vitamin shop July 2, 2002 Bankrupt health information Web site Drkoop.com announced yesterday that it is selling its assets, including its former members’ e-mail addresses, to online vitamin discount shop Vitacost.com. In an apparent reversal on privacy, Drkoop told members that they must opt out of the agreement by Sunday in order to prevent Drkoop from transferring their e-mail addresses to Vitacost. The opt-out provision appears to contradict an agreement Drkoop reached this spring with the Texas attorney general, as well as Drkoop’s published privacy policy (Gilbert, ZDNet News, 7/1). In March, the trustee overseeing the bankruptcy liquidation of Austin, Texas-based Drkoop agreed to terms established by the Texas attorney general to protect the privacy of site visitors. The agreement specified that, if sold, Drkoop would not transfer members’ personal information to the buyer unless members provided explicit consent. Drkoop agreed to notify customers of a potential sale and ask their consent to transfer information. If a customer declined or didn’t reply, Drkoop would destroy the user’s information (Technology in Practice, 3/26). In an e-mail sent to Drkoop members yesterday, however, the company said that, if members did not explicitly decline, it would transfer their e-mail addresses to Vitacost and its affiliate, HeartCenterOnline.com, a site for cardiovascular patients. The e-mail was signed by Drkoop Vice President Chris Petrovic. The terms of the sale also appear to violate the privacy policy posted on Drkoop’s Web site, which states that members’ information “will not be disclosed to anyone unless the visitors indicate that Drkoop may do so” (ZDNet News, 7/1).
