After reading that document several times I'm still not sure what it means.

Any agreement or instrument pursuant to which a Lender sells such a participation shall provide that such Lender shall retain the sole right to enforce the Loan Documents and to approve any amendment, modification or waiver of any provision of the Loan Documents;provided that such agreement or instrument may provide that such Lender will not, without the consent ofthe Participant, agree to any amendment, modification or waiver described in the first proviso to Section 9.02(b) that affects such Participant.

What the heck does the statement in italics mean, and what is Section 9.02 (b)? Beats me.

One thing seems apparent; who ever controls the vender financing, controls LWIN's fate.

Even if LU maintains enforcement control of the transferred loan provision, their principal financial incentive to keep Leap afloat has been diminished.

Also, how much influence does the new owner of the vender paper rein over Lucent? Are they a competitor or friend of LWIN?

Alot of important information just isn't known to individual investors which makes this investment a roll of the dice.
