No, that would be sheer idiocy. In a time of uproar, crowds are prone to act hysterically. That's why the U.S. is a representative democracy with abundant checks and balances in the system. It's completely clever, but it certainly isn't democracy. The Founding Fathers wisely feared the will of the Mob, and tried to make sure that the passions of the people couldn't wreck the government or our collective futures.

You do realize you are talking about human beings, right? Irrationality, hysteria, running amok and generally being stupid is the norm. Unnecessary emotions are what millions live for, please don't take away their rights!

It was meant to be harsh because it was such a stupid choice they made to violate the "establishment" clause of the Constitution. It was completely demagogic, i.e. it was designed to stir up raw emotion in order to propagandize the population into a contrived frenzy.

If the majority understands that the needs of the minorities, then a lot of unnecessary emotions won't rise up to such a frenzy.
