Because the "under God" was added by an act of congress in 1954.


I'm not sure if that amounts to the establishment of a religion unless it somehow requires people to say "under God". It was an act of congress but I'm not sure how it really mandates or prohibits anything. It would seem to me to be more of an expression that the majority of congress thinks that its a good idea if people say "one nation under God".

However I've never actually researched this act of congress. If anyone has more information about it or maybe even a transcript of it I would appreciate seeing it posted here.
