The source of clarity is the meaning of the phrase in English usage, after it had been coined in the early 18th century, and its subsequent reference only to official churches, as, for example, the Lutheran Church in Sweden. m-w.com Now, at the time of the composition of the Constitution, several states had established churches. The peculiar phrasing (make no laws respecting) forbade the Congress not only from establishing a national church, but from disestablishing the state churches. After the Civil War, the doctrine of incorporation (derived from the 14th amendment), which applied the Bill of Rights directly to state laws, superceded that provision, without changing the language, and henceforth states could not establish churches either.......
