Bush called for adding another $100 million to the SEC budget, far less than the $800 million called for in a bill currently being considered by the Democratic-controlled Senate.
But critics point out that Bush has dragged his feet on a critical step that would cost nothing: filling two empty SEC seats — vacancies that have hampered enforcement efforts. Last month, for example, an administrative law judge dismissed an action against the accounting firm Ernst & Young because only one commissioner voted in the case; past ties to Ernst & Young prevented SEC Chairman Harvey L. Pitt and commissioner Cynthia A. Glassman from voting.
“How can you have an effective SEC with vacant seats?” said Teslik. “They’ve been vacant since Enron hit. They’re easy to fill, there are candidates.
