Well, color me old fashioned, but I like to think that professionals have professional ethics if not business ethics. Our institutions that provide professional certification are a key in what makes our system work. When priests abuse children and accountants look the other way, I think that's a bigger problem than when business people scam. I also think it's a problem when politicians do it, but I've given up on them. We can't afford to give up on our professionals.

From a more practical perspective, we really can't afford to keep professionals in line only with criminal penalties. We rely on the AMA to do it's thing. The SEC relies a lot on self regulation by the industry as do other regulators. We may need to tweak that mix a bit, but we sure can't have the regulators go it alone. It would bankrupt us.
