Waitaminute. Wasn't the head of the SEC that refused to exonerate Bush Jr. appointed by Bush Sr.?

Does the SEC ever issue "exoneration" letters? I thought their criminal responsibilities were limited to Justice Dept referrals and, as such, correspondence limiting their breadth of investigative powers were not within their scope.
