First of all if you're charged with a crime you're entitled to counsel. These people are being denied even that. As for the prisoners in Cuba they're being held completely incommunicado. Not even granted prisoner of war status, and therefore conveniently not subject to the Geneva Convention. Since the Americans couldn't even speak the language it's a fair bet that many of these prisoners are innocent. Going back to the prisoners in the US what distinguishes them from the Japanese held in WW2? As far as we know no charges have been laid. Yet the prisoners are being held. Internment all over again.
