I found it interesting that even the New Yorker accepted the inevitability of overturn. The Talk of the Town on July 15 in its first sentence says "...on account of a soon-to-be-overturned court decision..."

I think the 9th circuit may overturn it, not because they believe the decision was wrong, but because they might not want to give the Supreme Court the chance of issuing a decision on the issue which could go much further than just reinserting the two words.
