I'm not trying to "make a case". Just pointing out that at the time an insider makes a trade on the basis of material non-public information, the insider does not know what effect the release of the information will have. The trade is based on reasonable expectation, and the failure of that expectation to materialize does not change the intent. A failed attempt at unethical dealing may not be prosecutable. If you're looking at it as an indicator of character, is as revealing as a successful attempt.
