No, but the implementation details might be. And the reverse engineering of IA-64 would be a very time-consuming process...

PS: It must be that the budgets of the web publishing guys are way down. The only reporting from platform conference comes from Japanese journalists.

Not necessarily true. For example AMD publicly acknowledged that the prior patent license agreement did not cover Intel's new PII and later bus.
