Judge Grants EchoStar's Motion for Summary Judgment Against Gemstar, Dismisses
Case and Awards Echostar Court Costs

LITTLETON, Colo.--(BUSINESS WIRE)--July 26, 2002--EchoStar
Communications Corporation (Nasdaq: DISH), a leading direct broadcast
satellite (DBS) television provider, announced today that the U.S.
District Court for the Western District of North Carolina granted
EchoStar's motion for summary judgment against Gemstar Development
Corporation and SuperGuide. The court found that none of EchoStar's
products infringe on any of the patents asserted. Accordingly, Judge
Lacy H. Thornburg dismissed the case and awarded EchoStar its court
costs.
As announced on July 3, 2002, Judge Thornburg previously ruled
that all but two of EchoStar's products did not infringe the patents
asserted by Gemstar. With respect to the two products, Judge Thornburg
requested additional information before reaching a final ruling. In
today's order, Judge Thornburg ruled that the remaining two products
also did not infringe the asserted patents.
"We're pleased that the court has found that none of EchoStar's
products infringe any of the patents asserted by Gemstar in this case
and ordered reimbursement of our costs," said David Moskowitz, senior
vice-president and general counsel of EchoStar.

internationally. ETC also oversees the delivery of interactive

Since I was long MRVL yesterday , I aved down on those sell-offs to the $14's and loaded more ,

don't ask me why was just playing hunch and remembering how this baby does like to bounce ....at least ther moneyflow has been more positive than for BRCM ...

Don't think it's getting anywhere past $20 , but I remember all to well how it sold off to $12's once after a SONS warning , and then bounced and ran to the $40's . Still trying to get my mind around it's technology and why they like it so much ....

anyways it's $16.50 now ....
