If you've ever purchased a stock based on analyzing the fundamentals of the company, you should also understand that the same thing can be done for shorting. Would I short those two stocks based on that information? Probably not, but I can point you to someone who is doing that with IBM. Changing laws are very much a part of the fundamental picture.
