I agree in taking into account mitigating circumstances, I want execution to be reserved for egregious cases, and not easily handed down. On the other hand, I am not sure where the cut- off should be. It seems to me that someone who is highly functional, with an IQ around 70, does not have a case, absent other factors. On the other hand, I do not know how someone with an IQ of 50 could even stand trial, since he is supposed to be capable of aiding in his own defense, and therefore that seems to be sufficient grounds for protecting him against the ultimate penalty.
