Neo, I also think that we make too much of intent when assessing responsibility and I don't think that is healthy. If you cause something to happen, you're responsible. Period. All the rest of is is just excuse making. Excuse making is a very slippery slope with no end in sight and a lot of controversy over which excuses are good excuses. I opt for no excuses. If we're going to execute people, I see no reason not to execute the mentally retarded.

I'm not sure I should care why you struck the person down (unless of course they were truly attempting to kill you, or strike you first). Whether you were under the impression you were in Vietnam, or killing knowingly, it matters not at all to the victim, and I'm not sure why it matters to society, or why it should matter to me. It seems to me it just wastes time looking into the issue.

Nope, not hard. It is very easy to conceal, camouflage, or fabricate. However, a raping murderer and his honorable attorney would only work to provide evidence to the true motive behind a killing. It's not all that hard ... to do any of the above.
