It would be a travesty of justice to hold someone accountable for an accidental death to the same degree as someone acting with malice aforethought..... No, it would be inappropriate to punish them equally, but they're equally responsible. I think that's an important point. We need to distinguish between responsibility and punishment to allow people to accept responsibility. Now, people who want to avoid punishment must deny responsibility for fear of incurring a excessive punishment.
