The mandated recounts had been performed. Recounts by hand were not necessary, until the Florida Supreme Court, overturning a trial judge and in a split decision, mandated them.

The Majority in Bush v. Gore basically acknowledged that all the legal votes still haven't been counted even though such would violate its own equal protection principles. That's not what the Court held. The Court held that the votes had been counted under the rules that existed prior to the election.

The Florida Court directed that it was ok to re-count only some of the counties where-in more legal votes might be found. That thought was ruled unconstitutional by the Supreme Court, 7-2. Gore's wonderful lawyer had asked for partial counting. It was always obviously wrong to do...if desperate indeed, too. Dan B
