Your probably on to something there, Scott. Notice that there has been a big show of execs being led around in handcuffs. Someone is trying to look tough, while attempting to let Lay and pals slide off of the radar screen. Seems pretty obvious to me. When the Shrub talks about getting tough on corporate crime, you can hear it in his voice that he is not really behind the effort. He's just reciting what was written for him.
