More details here.

The police let a guy who registered a .21 go, after less than 3 hours sobering time. And it appears they knew he was going back to his car. That makes no sense.

Police are at least as responsible as Powell, IMO.

It is NOT foreseeable (and in fact it amazes me) that this guy would take his car and go get drunk again.

I suppose it would depend on the individual. We were discussing this today over lunch and agreed, had we been picked up for drunken driving, we would be so chastised that we would go right home and pull the covers over our head, not drinking, maybe never again drinking, maybe not even driving for a while. OTOH, if the guy were a certifiable drunk, then he would deal with the stress of his arrest by drinking. Presumably this "friend" knew him well enough to know which.

I just flipped on court TV that the defendant was not told his friend had been arrested for drunk driving, only that he had been arrested.
