No, at least not in NY...to the best of my knowledge our max is 2nd degree even though we got the death penalty law from Pataki 8 years ago..Pataki's major campaign pledge was the death penalty.......btw, no one has been executed yet.

Not by my reasoning.....but I think that almost everyone who calls for and votes for a politician who supports the death penalty law intends it to be used for all murders...I have done personal surveys during discussions on this many times ...and they don't seem to realize or even care that their politicians have deceived them by placing all kinds of legal obstacles in front of execution. I believe the average person who supports the death penalty wants the perp torn limb from limb and not "put to sleep" on a gurney. It doesn't seem to occur to them that we have about 30,000 murders a year in this country but only about 250 executions mostly thanks to Texas. NY has had the penalty for 8 years, NJ has had it at least 15.....how many total executions? Zero!!! I quess there were no murders in these states for all those years.
