Perhaps. Seems like a detail to me, although I'll bet they are thinking about that side of it. It is so utterly shocking to me that the government would step in to soften the blow to individual speculators. Since the mid-nineties they have inculcated this notion that there is no high-risk in the markets. They bailed out big players time and time again. Now they will spread this contagion to the individual.

I would think most have already sold

Many are sitting on fat capital loss carryovers from previous years as well.

But December will have the usual round of tax loss selling as it always does, regardless.
