John, Nah, the poor, undereducated U.S. Attorney in Philly is hoping to scare them into a face-saving settlement. And it is not just Medco, it's the entire industry. Medco is just the largest and the first focus. This weak letter was actually viewed as positive news yesterday, in that the govt. is finally stating its concerns instead of using vague "we dont' like you or the horse you rode in on" innuendoes in the media.

The only real question is, are people who use PBMs getting lower priced prescriptions than those who don't? And the answer is overwhelmingly, yes. Is the industry competitive enough so nobody can grab pricing power. Yup. Are the cos. representing both the employer health care cos. and the drug cos.? Yes, and they admit it. That is the main bugaboo and there may be some changes there. I guess it could be illegal to get a patient drugs cheaper by pushing a drug cos' rebate program, but, for some reason, I think we want them to do that.
